State regulators diverge on stablecoin safe harbor as GENIUS Act deadline looms

State banking regulators are urging the U.S. Treasury to establish safe harbors for state-licensed stablecoin issuers ahead of the January 18, 2025, effective date of the GENIUS Act. The Conference of State Bank Supervisors (CSBS) warns that without these protections, issuers may abandon state oversight in favor of federal pathways through the OCC, undermining the dual-banking system intended by Congress. A primary point of contention is the timing gap created by the Treasury missing its July 2026 deadline for finalizing regulatory principles, leaving states unable to secure Stablecoin Certification Review Committee (SCRC) approval by the January deadline. Conversely, the New York Department of Financial Services (NYDFS) argues that no safe harbor is necessary, asserting that the statute already permits continued operations while expressing concern that federal rules may be too lenient on foreign issuers. Mastercard has also intervened, requesting that the Treasury clarify the threshold at which service providers are classified as unlicensed issuers. This regulatory friction highlights the ongoing struggle to harmonize state-level stablecoin frameworks with emerging federal standards. The outcome of these negotiations will determine the operational viability of state-regulated stablecoin entities and the future competitive landscape of the U.S. digital asset market.
