EU Launches Review of Tokenized Collateral, Including Legal Rights Checks

The European Securities and Markets Authority (ESMA) has launched a formal consultation to evaluate the safety and operational viability of using tokenized collateral within EU central counterparties (CCPs). This initiative seeks to address critical concerns regarding the legal certainty of ownership, settlement finality, and the integration between distributed ledger technology and traditional financial infrastructure. ESMA is specifically investigating whether tokenized assets, including those issued directly on-chain or backed by traditional securities, can be liquidated efficiently without facing unexpected redemption delays or transfer restrictions. The regulator is also examining the role of stablecoins, CBDCs, and tokenized deposits in facilitating these collateralized transactions. Industry stakeholders have until January 15 to provide feedback, which will inform potential updates to the existing EU regulatory framework. By addressing these systemic risks, ESMA aims to establish a robust supervisory environment that supports the secure expansion of the tokenized asset market. This move represents a significant step toward institutionalizing on-chain collateral management within the European financial system.
